Elon Musk's X Wins Legal Challenge to Allow Viewing for Australians to Controversial Shooting Footage

Following a notable regulatory appeal, a national review panel has overturned a prior decision that prevented Australian-based users from accessing video footage of the shooting incident involving influencer Charlie Kirk. The appeal was initiated by Elon Musk's social media platform, arguing against an directive sought by the online safety regulator.

Details of the Case and Classification Ruling

Following the fatal shooting of Charlie Kirk at a US campus in last year, the regulator petitioned the review board to officially classify the available footage. The board initially ruled the content was "refused classification", a rating that allowed the regulator to instruct social media companies to geo-block the posts for users in Australia.

Elon Musk's company filed an appeal for two separate videos depicting the Kirk incident. It also appealed a similar ruling on another piece of footage—depicting the assault of Iryna Zarutska on a train in Charlotte—which had likewise been classified as "unacceptable for distribution".

The Platform's Case and Board's Decision

Arguing its case, X asserted that the footage in question contained only brief violence with no visible weapon. The company noted the recording was low-quality and the camera quickly panned away from the victim to the surrounding crowd.

The social media giant maintained the footage was not overly graphic, gratuitous, or objectionable, adding that it served as a factual documentation of "a notorious public event of public importance that prompted widespread discussion". X even compared the footage and the historic film of President John F. Kennedy's assassination.

Most members of the review board concluded that, "notwithstanding the heinous nature of the event," the content did not reach a level that was exploitative, gratuitous, or offensive enough to warrant a 'refused classification' rating. The board suggested that a more detailed depiction with alternative commentary could have met that threshold. Consequently, the panel changed the classification of the videos to R18+.

A Dissenting Opinion

A minority on the panel held a contrary view, arguing the post was "content designed for sharing for the likely purposes of amusement and/or benefit (such as engagement metrics)". They also argued the comparison to the JFK assassination tape was invalid, as the Kennedy video was released long after the event, "after public sentiment around the matter had subsided".

Response Following the Outcome

Posting on its official policy channel, the platform expressed approval of the decision.

"We challenged this case to uphold free speech and the critical nature of access to information about issues of public interest. We remain committed to protecting these principles."

A spokesperson for the safety regulator acknowledged the board's decision, but noted that the new R18+ rating now implies platforms "must take steps to ensure R18+ material is not accessible to users under 18".

Recent Developments on Violent Content

In related news, the regulator has not issued take-down orders to social media companies this week regarding graphic footage from the recent Bondi beach terror attack shared across social media. Officials commented that while the content were distressing, they had not met the high threshold for a "total ban" rating.

Instead, the companies have been advised to apply sensitive content labels and interstitials, such as blurring, on this material in line with their existing community guidelines.
